TAF Master's General Privacy Statement

Effective as of January 11, 2005

Focalex, Inc. supplies advertising services via its TAF Master program to a network of affiliate Web sites (referred to hereafter as the "TAF Network") by displaying TAF Master's forms. The information collection, use, maintenance and disposal practices of the TAF Network are discussed in this privacy policy. For details of Focalex's relationship with its TAF Network affiliates, please review the Affiliate Privacy Statement.

1. Collection of Information.


1.1 Survey Information.

The TAF Network collects information from individuals when such individuals voluntarily complete TAF Network surveys, order forms, send an email through the TAF Network's referral engine technology or submit information via an online forms which may or may not be accompanied by a pre-checked or non-pre-checked checkbox indicating that such individuals consent to receiving marketing communications from the TAF Network (a "Co-registration"), or a registration pages either online or offline, or by means of online or offline surveys, order forms, or registration pages operated by third parties (each, a "Survey"). (As used herein, "online" means using the Internet, including the websites and related technologies, and "offline" means by methods other than online, including in person, via postal mail, telephones, and other similar means.) In the Surveys, the TAF Network or a third party may ask individuals to provide various information to the TAF Network, which may include their name, email address, street address, zip code, telephone numbers, birth date, gender, salary range, education level, marital status, occupation, employment information, personal and online interests, and such other information as may be requested from time to time (collectively, "Survey Information"). Completing the Surveys is completely voluntary, and individuals are under no obligation to provide Survey Information to the TAF Network or any third party, but individuals may receive incentives from the TAF Network or a third party in exchange for providing Survey Information to the TAF Network.

1.2 Other Information.

Other occasions when the TAF Network obtains information from individuals include when such individuals (1) make a claim for a prize or seek to redeem an incentive offered by the TAF Network or a third party, (2) request assistance through the TAF Network's customer service department, and (3) voluntarily subscribe to a TAF Network service or newsletter (collectively, "Other Information").

1.3 Cookies, Web beacons, and Other Information Collected Using Technology.

The TAF Network may use cookie technology to associate certain Internet-related information about individuals with information about such individuals in our database. Additionally, the TAF Network may use other new and evolving sources of information in the future (together, "Technology Information").

(a) Cookies. A cookie is a small amount of data stored on the hard drive of the individual's computer that allows TAF Network to identify the individual with his or her corresponding data that resides in TAF Network's database. You may read more about cookies at www.cookiecentral.com.

(b) Web beacons. Web beacons are graphic images, often transparent and no larger than 1 pixel x 1 pixel, that are placed on a Web site or in an e-mail. Web beacons are used to monitor the behavior of the user visiting the Web site or opening the e-mail. When the HTML code for the Web beacon points to a site to retrieve the image, it simultaneously can pass along information such as the IP address of the computer that retrieved the image, the time the Web beacon was viewed and for how long, the type of browser that retrieved the image and previously set cookie values. The TAF Network, or third parties acting on the TAF Network's behalf, may utilize Web beacons on Web pages or in email for any legally permissible purpose.

(c) General Behavior Tracking. The TAF Network may track online behaviors ("Behaviors") through its own technologies, including its desktop software products, in order to increase the effectiveness of the advertisements it delivers. Examples of such behaviors may include advertisement responses, websites that individuals visit, and products that individuals purchase. Individuals can prevent the tracking of Behaviors by globally unsubscribing from the TAF Network's marketing materials. As described in Section 2.1, the TAF Network reserves the right to use such technologies for any purpose permitted by law.

(d) Information Automatically Collected. For site maintenance, optimization, security and other legally permissible purposes, the TAF Network's servers (or third party servers) may collect certain information about website visitors automatically. Such information may include such visitors' IP address, browser type, date, time and duration of visit and particular pages viewed, and such other information as is permitted by law.

(e) New Technology. The use of technology on the Internet is rapidly evolving, as is the TAF Network's use of new technology. As previously stated, TAF Network reserves the right to change this policy at any time without any additional notice to the user. As a result, the TAF Network strongly encourages individuals to revisit this privacy policy from time to time for any updates regarding its use of technology. Use of any TAF Network website constitutes acknowledgement and acceptance of the TAF Network's Privacy Policy and the TAF Network's right to modify such Privacy Policy without additional notice.

1.4 Outside Information.

The TAF Network may receive information about individuals from a third party or from other sources of information outside of the TAF Network including information located in public databases ("Outside Information").

1.5 Individual Information.

As used herein, "Individual Information" means Survey Information, Other Information, Technology Information, and Outside Information, and any other information the TAF Network gathers or receives about individuals.

1.6 No Information Collected from Children.

The TAF Network will never knowingly or intentionally collect any personal information about children under the age of 13. If the TAF Network obtains actual knowledge that it has collected personal information about a child under the age of 13, that information will be immediately deleted from its database. Because it does not knowingly or intentionally collect such information, to the best of the TAF Network's knowledge and belief, the TAF Network has no such information to use or to disclose to a third party. The TAF Network has designed this policy in order to comply with the Children's Online Privacy Protection Act.

1.7 Credit Card Information.

The TAF Network may in certain cases collect credit card numbers and related information, such as the expiration date of the card ("Credit Card Information") when an individual places an order from TAF Network. When the Credit Card Information is submitted to the TAF Network, such information is encrypted and is protected with SSL encryption software. The TAF Network will use the Credit Card Information for purposes of processing and completing the purchase transaction, and the Credit Card Information will be disclosed to third parties only as necessary to complete the purchase transaction.

2. Use of Individual Information.


2.1 Discretion to Use Information.

THE TAF NETWORK MAY USE INDIVIDUAL INFORMATION FOR ANY LEGALLY PERMISSIBLE PURPOSE IN THE TAF NETWORK'S SOLE DISCRETION. The following paragraphs in Section 2 describe how the TAF Network currently uses Individual Information, but the TAF Network may change or broaden its use at any time as permitted by law. As noted below, the TAF Network may update this policy from time to time. The TAF Network may use Individual Information to provide promotional offers to individuals by means of email advertising, telephone marketing, direct mail marketing, and online banner advertising, among other uses.

2.2 Email.

The TAF Network uses Individual Information to provide promotional offers by email to individuals who have permitted use of their email address for this purpose. The TAF Network may maintain separate email lists for different purposes. If email recipients wish to end their email subscription, they need to follow the instructions at the end of each email message to unsubscribe.

2.3 Targeted Advertising.

The TAF Network uses Individual Information to target advertising to individuals. When individuals use the Internet, the TAF Network uses such persons' Individual Information to show advertising for products and services in which those users have expressed an interest, whether directly or indirectly.

2.4 Direct Mail and Telemarketing.

The TAF Network may use Individual Information to advertise or provide promotional offers, directly or indirectly, to individuals using direct mail marketing or telemarketing using telephones, as permitted by law.

2.6 Storage of Individual Information.

The TAF Network stores Individual Information in a database on TAF Network computers. TAF Network computers have security measures (such as firewalls) in place to reasonably protect against the loss, misuse or alteration of the information under the TAF Network's control. Notwithstanding such measures, the TAF Network cannot guarantee that its security measures will prevent TAF Network computers from being illegally accessed, and the Individual Information on them stolen or altered.

2.7 Rights of Third Party Affiliates.

TAF Network may extend any of its rights under this Agreement to third parties performing services on its behalf.

3. Dissemination of Individual Information.


3.1 Sale to Third Parties.

The TAF Network may sell or transfer Individual Information to third parties for any legally permissible purpose in the TAF Network's sole discretion ("Data Sale"). A Data Sale shall not be defined to mean a merger, acquisition, change in capital structure, sale of all or substantially all of the assets of any TAF Network division, or any activity specified in Section 3.2, 3.3, or 3.4 below. Each time the TAF Network enters into a Data Sale, the TAF Network will send an email ("Data Sale Notice") to individuals who have entered a valid email address into a Survey. The Data Sale Notice will contain instructions on how to prevent the individual's data from being sold to such specific third party. There is no guarantee that an individual will receive the Data Sale Notice due to technical failure, service provider email filtering mechanisms, or other unpredictable failures of transmission. Individuals that did not provide valid email addresses, or who no longer have the same email address, will not receive a Data Sale Notice. Failure to receive a Data Sale Notice shall not restrict the TAF Network's ability to sell data under Section 3.1.

3.2 Order Fulfillment.

The TAF Network will transfer Individual Information to third parties as necessary to provide a product or service that an individual orders from such third party while using one of the TAF Network's websites or when responding to offers provided by the TAF Network.

3.3 Legal Process.

The TAF Network may disclose Individual Information to respond to subpoenas, search warrants, court orders, or other legal process.

3.4 Summary Data.

The TAF Network may sell or transfer non-individualized information, such as summary or aggregated anonymous information about all persons or sub-groups of persons.

4. Privacy Practices of Third Parties.


4.1 Advertiser cookies and web beacons.

Advertising agencies, advertising TAF Networks, and other companies (collectively, "Advertisers") who place advertisements on the TAF Network's websites and on the Internet generally may use their own cookies, web beacons, and other technology to collect information about individuals. The TAF Network does not control Advertisers' use of such technology and the TAF Network has no responsibility for the use of such technology to gather information about individuals.

4.2 Links.

The TAF Network's websites and email messages may contain hypertext links to the websites of one or more third parties. The TAF Network is not responsible for the privacy practices or the content of such other websites.

4.3 Affiliated Companies.

The TAF Network may disclose, transfer and sell Individual Information to an entity which becomes affiliated with TAF Network through formation, merger or acquisition, in the TAF Network's discretion.

5. Unsubscribe from Intermix lists.

The TAF Network maintains multiple newsletter and email marketing lists. To unsubscribe from one or more of such lists, click the link included in the footer of any message delivered by the TAF Network and follow the instructions provided.

TAF Master's Affiliate Program Privacy Statement

TAF Master's Affiliate Program consists of a network of publisher sites that earn monthly revenue for displaying TAF Master's forms. TAF Master's rights of privacy, declared and explained within TAF Master's general privacy statement, encompass anyone that submits information from an affiliate's site(s) to a TAF Master sign up form. The TAF Master Affiliate Team oversees all support representation for program membership. Inquires for the affiliate program can be submitted by form, by phone at 781-419-6545, and finally by postal mail, The TAF Master Affiliate Team, 300 Fifth Avenue, 3rd Floor, Waltham, MA, 02451.

The TAF Master Affiliate Program's guidelines are clearly stated in our terms and conditions. All affiliate members, upon registration, have certified that they have read the document and will participate in the TAF Master Affiliate Program in adherence to the program's terms. TAF Master is an advocate of honest and ethical business practices. As such, TAF Master's Affiliate Program does not condone Internet abuse or fraudulence in any regard. Due to the large network of affiliate members, it is sometimes unknown to The TAF Master Affiliate Team that abuse and/or fraudulence are taking place on a member's site(s). The TAF Master Affiliate Team encourages bringing these cases to our attention by sending a detailed email to abuse@tafmaster.com.

Information Collected

Publishers who submit an application for entry to the TAF Master affiliate program are asking to form a business relationship with TAF Master. As such, the application will ask for detailed information that is for internal use. This information will not be provided to outside parties, except in cases of abuse or suspected abuse; fraud or suspected fraud; or by legal, civil, or governmental request.

TAF Master Affiliate Program registration takes place at solutions.focalex.com. Required fields are name, email address, mailing address, city, zip/postal code, country, URL, and a check to certify that the terms of service have been read. The Social Security number or Tax Identification number are only required for United States citizens. TAF Master does offer a secure server that is linked from the main registration page. The secure server safely encrypts information via the web-based registration form. If the affiliate comes to the registration form from a webmaster referral, TAF Master does track the promotion code via cookie (see below for more details on cookies). This information is considered proprietary and private, and is protected with strict standards.

Affiliates' Sites

TAF Master cannot and will not be held responsible for actions that take place on an affiliate member's site(s). The user in this instance will be protected only by the respective affiliate member's privacy policy. In the case that a user's privacy is compromised on an affiliate member's site(s) while submitting a TAF Master sign up form, please contact us at abuse@tafmaster.com and we will answer the request immediately.

Cookies

Please see the General Privacy Statement for a definition of cookies. TAF Master uses cookies for validation, tracking, as well as to customize displays. While an affiliate can use the site without cookies enabled, displays will not be customized, and in some cases, the site may not work at all.

Logins

Affiliate members login to their respective accounts at http://solutions.focalex.com. This will grant the affiliate member access to the TAF Master affiliate member's section. The login page accepts two fields, email address and password, which were specified upon registration. An affiliate member will not be able to login to their respective account without cookies enabled within their browser preferences.

Indemnity

The affiliate member agrees to defend, indemnify, and hold harmless TAF Master and its directors, officers, agents, and employees for any and all losses, costs, liabilities or expenses (including, without limitation, reasonable attorneys' and expert witnesses' fees) incurred or arising from (a) any breach of Affiliate Member's Covenants, (b) any user-generated content or (c) any claims arising from the sale or license of goods or services promoted or made available through TAF Master. TAF Master's indemnity rights shall not be limited or offset by any contributory negligence by TAF Master. TAF Master may participate in the defense at its expense.
