WebGames may edit this privacy policy from time to time. We recommend that you check this page periodically for updates on our policy, as use of the WebGames service will constitute implicit agreement to these terms, as well as any changes. WebGames created this privacy statement in order to demonstrate our firm commitment to privacy. The following discloses our information gathering and dissemination practices for this web site.
Please note that use of the WebGames forms establishes a business relationship between WebGames and the surfer. We are providing a service to surfers by routing their requests through our servers, scripts, and resources.
Information Collected
In order to assist fraud investigations, abuse investigations, quality assurance, earnings calculations, advertiser requests, and to improve the surfer experience, various bits of personal data may be collected in the process of using the WebGames service. This information could include any data submitted while using the service, such as name and email address, as well as any other diagnostic data available as part of the standard web surfing experience (such as IP address). This information is solely for use by us, and is not provided to outside parties. The IP and date of the WebGames ad request is logged. This is to prevent abuse of the system, as well as to provide recourse for those who are seeking more information on an abuser. Additionally, some non-personally identifiable information may be collected and provided back to affiliates. This data is not shared or otherwise publicly exposed, and is provided to allow the affiliates to improve the quality of service.
Third Party Advertisers
The WebGames system is designed to provide information and offers from third party companies to the surfer. These come by way of deals / lead generation, as well as by advertising displayed throughout the WebGames game playing process. In addition, other advertisements may be placed in the service by affiliates, over which WebGames does not have control. When these offers are present in the WebGames system, they are clearly marked as third party offerings. These offers are provided to the surfer as an opt-in, and as such, the surfer can opt to not provide their information to third parties. These offers are completely voluntary, and if a surfer does not wish to opt-in for such offers, they should not sign up for them. If a surfer elects to receive such information or visit off site links, they agree to allow their data to be transmitted to those third parties. As these third parties are not under the control of WebGames, the surfer should be aware of the privacy policies of those specific sites. We recommend the surfer check those sites' privacy policies to be sure they are aware of the use of their personally identifiable information.
The web pages at WebGames, the domain webgames.focalex.com, and some of the email sent by WebGames contain links to external sites beyond our control. WebGames cannot represent or guarantee that these third parties' privacy statements conform to our privacy policies. Any site linked to the WebGames site may have a Privacy Statement that differs from our own. Please review the privacy statement of any site linked from WebGames.
Cookies
WebGames uses cookies for a variety of purposes. Cookies are a piece of data stored in the browser's memory, and may or may not be written to the surfer's hard drive when the browser is closed. This allows customization of what is displayed to the surfer across sessions, enables tracking of user actions, and user profiling. Information stored in cookies may be added to our databases, or used as a means to identify a user. While a user can use WebGames sites without cookies enabled, displays will not be customized, and in some cases, the site may not work at all. Turning off cookies also limits the ability, or in some cases precludes the ability, to participate in various WebGames contests, offers, and giveaways. Some of the advertisers who use our site (both on the web and in e-mail messages) may use cookies on their site. This is something over which WebGames has no control.
COPPA
In accordance with COPPA regulations, WebGames does not allow individuals aged 13 or younger to participate in contests and promotions on pages where WebGames asks for age. Data is not collected from individuals specifying an age of 13 or less. WebGames in some cases employs a drop down box that will only collect data from those citing a year that states their age to be over 13.
Block Lists
WebGames maintains block lists of both specific email addresses as well as domains, in an effort to prevent abuse of the system. We honor requests to block all future mail, both on the sending and receiving side, though we reserve the right to make the final judgment regarding whether or not a particular email address or domain should be added to the lists. Security Measures
This site has security measures in place to ensure against the loss, misuse, or alteration of information under our control. WebGames protects the integrity and security of its data by following industry-standard procedures and guidelines. Only key executives and members of the development team at WebGames possess the passwords required to access files requiring security clearances. All WebGames employees are made aware of corporate security policies upon hire, change of position or change of policy.
Severability
If any provision of this document is deemed unenforceable or illegal, the remaining provisions shall remain in full force, and shall not be negated or invalidated. The provision deemed unenforceable or illegal shall be modified by both parties to carry out the intention of the provision as noted in this document.
Indemnity
The surfer agrees to defend, indemnify, and hold harmless WebGames and its directors, officers, agents, and employees for any and all losses, costs, liabilities or expenses (including, without limitation, reasonable attorneys' and expert witnesses' fees) incurred or arising from (a) any breach of surfer's Covenants, (b) any user-generated content, or (c) any claims arising from the sale or license of goods or services promoted or made available through WebGames. WebGames' indemnity rights shall not be limited or offset by any contributory negligence by WebGames. WebGames may participate in the defense at its expense.
Any additional information offered or any additional services requested by you, the user, outside of the WebGames domain will be subject to the Privacy Statement within that particular site. WebGames is not responsible for actions by the user outside of the WebGames network.

Affiliate Program Privacy Statement
WebGames' Affiliate Program consists of a network of publisher sites that earn monthly revenue for displaying WebGames' advertising. WebGames' rights of privacy, declared and explained within WebGames' general privacy statement, encompass anyone that submits information from an affiliate's site(s) to a WebGames sign up form. The WebGames Affiliate Team oversees all support representation for program membership. The WebGames Affiliate Program's guidelines are clearly stated in our terms and conditions. All affiliate members, upon registration, have certified that they have read the document and will participate in the WebGames Affiliate Program in adherence to the program's terms. WebGames is an advocate of honest and ethical business practices. As such, WebGames' Affiliate Program does not condone Internet abuse or fraudulence in any regard. Due to the large network of affiliate members, it is sometimes unknown to The WebGames Affiliate Team that abuse and/or fraudulence are taking place on a member's site(s). The WebGames Affiliate Team encourages bringing these cases to our attention by sending a detailed email to abuse@focalex.com.
Information Collected
Publishers who submit an application for entry to the WebGames affiliate program are asking to form a business relationship with WebGames. As such, the application will ask for detailed information that is for internal use. This information will not be provided to outside parties, except in cases of abuse or suspected abuse; fraud or suspected fraud; or by legal, civil, or governmental request. WebGames Affiliate Program registration takes place at http://solutions.focalex.com. Required fields are name, email address, mailing address, city, zip/postal code, country, URL, and a check to certify that the terms of service have been read. The Social Security number or Tax Identification number are only required for United States citizens. If the affiliate comes to the registration form from a webmaster referral, WebGames does track the promotion code via cookie (see below for more details on cookies). This information is considered proprietary and private, and is protected with strict standards.
Affiliates' Sites
WebGames cannot and will not be held responsible for actions that take place on an affiliate member's site(s). The user in this instance will be protected only by the respective affiliate member's privacy policy. In the case that a user's privacy is compromised on an affiliate member's site(s) while using a WebGames product, please contact us at abuse@focalex.com and we will answer the request immediately.
Cookies
Please see the General Privacy Statement for a definition of cookies. WebGames uses cookies for validation, tracking, as well as to customize displays. While an affiliate can use the site without cookies enabled, displays will not be customized, and in some cases, the site may not work at all.
Logins
Affiliate members login to their respective accounts at solutions.focalex.com. This will grant the affiliate member access to the WebGames affiliate member's section. The login page accepts two fields, email address and password, which were specified upon registration. An affiliate member will not be able to login to their respective account without cookies enabled within their browser preferences.
